Terms & Conditions

These terms govern enrolment, payment, cancellation, and conduct for all courses and events offered by Padi Institute. Please read them carefully before submitting an enquiry or registering for a course.

1. Parties and Scope

These terms constitute the agreement between Padi Institute ("the Institute", "we", "us") and the individual registering for a course or event ("the Participant", "you"). The Institute operates from 82, Jalan Kelawai, 10250 George Town, Pulau Pinang, Malaysia.

These terms apply to the following programmes currently offered by the Institute:

These terms govern the relationship between the Institute and the Participant from the point of enquiry through to the conclusion of the relevant programme. They do not constitute a financial advisory relationship. Nothing in any course or material provided by the Institute constitutes advice in respect of any particular financial instrument, product, or transaction.

2. Enrolment and Registration

Enrolment is confirmed when the Institute has received a completed registration form or a written acceptance of a course offer and the applicable fee has been received and cleared. The Institute will send written confirmation of enrolment by email within five working days of receiving cleared payment.

Places are limited. The Institute does not hold places provisionally for longer than five working days without payment. If payment is not received within that period, the place may be offered to another applicant without further notice.

The Institute reserves the right to decline an application without giving reasons, in which case any payment received will be returned in full within ten working days.

Participants must be eighteen years of age or older. Our courses are designed for adults; we do not offer junior or family enrolment.

3. Fees and Payment

The fee for each programme is as stated on the Institute's website and in the course confirmation letter sent to the Participant. Fees are stated in Malaysian Ringgit (MYR) and are inclusive of all materials, unless the confirmation letter specifies otherwise.

Payment is due in full prior to the commencement of the relevant programme unless a written payment arrangement has been agreed with the Institute. The Institute will confirm available payment methods upon registration; we accept bank transfer and selected electronic payment methods.

The Institute does not offer instalment arrangements as a standard option. Requests for a staggered payment schedule may be considered at the Institute's discretion and will be confirmed in writing before the arrangement is binding on either party.

The fee does not include transport, accommodation, or any personal expense incurred by the Participant in attending a session.

4. Cancellation by the Participant

The Institute understands that circumstances change. The following cancellation terms apply:

Cancellation requests must be submitted in writing to [email protected]. The date of the written request determines which cancellation band applies. Verbal cancellations are not accepted for refund purposes.

A Participant who cannot attend may, with the Institute's prior written agreement, transfer their enrolment to another individual. The Institute should be notified of any such transfer no later than five working days before the first session. A transfer is not a cancellation and does not attract the cancellation charges above.

Where a Participant has paid but wishes to defer to a later intake of the same programme, the Institute will consider this request at its discretion. Deferrals are not automatic and are subject to place availability in the later intake.

5. Changes and Cancellation by the Institute

The Institute reserves the right to change the date, time, venue, or faculty member for any session. Where a material change is made, the Institute will give as much notice as reasonably practicable and will notify the Participant in writing.

If the Institute cancels a programme in its entirety before it commences, enrolled Participants will receive a full refund of the course fee within fifteen working days. The Institute's liability in this circumstance is limited to the refund of the fee paid and does not extend to any consequential loss, including travel or accommodation expenses incurred by the Participant.

The Institute does not guarantee a minimum class size for the Single-Subject Lecture. If a lecture session is cancelled due to low registration or circumstances beyond the Institute's control, enrolled Participants will receive a full refund. The Institute will endeavour to give at least seven days' notice in such cases.

6. Participant Conduct

The Institute's sessions are intended to be a quiet and respectful learning environment. Participants are expected to engage with faculty and fellow participants in a manner consistent with that intention.

The Institute may ask a Participant to leave a session if their conduct is disruptive or disrespectful to others. A Participant asked to leave on conduct grounds is not entitled to a refund of any portion of their course fee.

Mobile devices should be silenced during sessions. Recording of sessions — by audio, video, or screen capture — is not permitted without the prior written consent of the Institute and the relevant faculty member.

7. Course Materials and Intellectual Property

Written materials, reading lists, précis documents, and presentation slides provided as part of a programme are supplied for the personal educational use of the enrolled Participant. They may not be reproduced, distributed, sold, or published in any form without the written permission of the Institute.

The Institute's course materials incorporate the academic and professional judgment of its faculty. They represent the faculty's considered view at the time of preparation and will not necessarily reflect every subsequent development in law, regulation, or market practice. Participants should verify any specific detail that is material to a personal financial or legal decision before acting on it.

The Institute does not claim ownership of any written work submitted by Participants during a programme, such as exercises or case study responses. Such work remains the intellectual property of the Participant.

8. Limitation of Liability

Padi Institute provides educational instruction. The Institute does not hold a Capital Markets Services Licence, a financial planning licence, or any equivalent authorisation under Malaysian financial services legislation, and nothing in any course constitutes regulated financial advice.

Any decision made by a Participant in relation to their personal finances, estate, investments, or related matters following attendance at a course is made by the Participant on their own account and at their own risk. The Institute accepts no liability for any financial loss, tax liability, or legal consequence arising from a Participant's decision to act on, or refrain from acting on, anything discussed or presented during a course.

The Institute's liability to any Participant, in respect of any claim arising out of or in connection with a programme, is limited to the fee paid by that Participant for the relevant programme.

Nothing in these terms excludes liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under Malaysian law.

9. Personal Data

Personal data provided in connection with enrolment and participation is processed in accordance with the Institute's Privacy Policy, which forms part of the agreement between the Institute and the Participant. By registering for a programme, the Participant acknowledges that they have read the Privacy Policy.

10. Governing Law

These terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these terms that cannot be resolved by agreement between the parties shall be subject to the jurisdiction of the courts of Malaysia.

11. Amendments to These Terms

The Institute may update these terms from time to time. The version published on the Institute's website at the time of a Participant's registration is the version that applies to that enrolment. The Institute will notify enrolled Participants of material changes by email where such changes would affect a programme already registered for.
